Yes plus the fact people should avoid the crappy transfer issue whereby any content you download will now have to be played while signed into Xbox Live.

Not a huge problem, but an annoying one especially for those in the US and Canada using the Video Marketplace.

Well I suppose you could sell it to Xbox 360 Elite buyers (who already have an Xbox 360) as it doesn't come in the Box but It's no use to anyone else.
