You know if you used a characters name from a film book etc as your gamertag, do you think there is a chance you could be sued?

I would highly doubt it. I've seen plenty of peoples tag which are characters name etc

Jenna Jameson 7 - that was my favourite, played with her on GRAW1 aggggges ago.
Really only one celebs i've ever seen.

As a gamertag I highly doubt it but if you then went on to use that name outside the arena of playing on Xbox Live then maybe so...Such as using that name for a Website such as MajorNelson, Ozzymandias, LetsKillDave, etc

However purely using it on Xbox Live you won't get in trouble at all.

Yes it is. Copyright also comes into play when people take other people's copyrighted material and claim it to be their own. Which is where plagiarism comes into play.

On this view if possible could'nt they simply sue everyone in every forum (hence user name again) for copyright ?

I do think they can but they do not want to. It would have a massive backlash on them if they did..

Thanks to what I do for a living, I have access to legal people and I asked them about this. In the U.S., in order for you to get sued for using a name, name from a show, character name, etc. it would be if that name was a copyright registered name. Then the copyright registered name would have to be used exactly like it is. So if it was SuperMan, the copyright registered name would have to be spelled and spaced the same way. They said your more opt to get sued for a person falling in your home than this. They also said if it is a business name that is a total different thing. Hope that helps.
