Has anyone had their out of warranty 360's replaced for free by MS?

Did they acknowledge that it was out of warranty but would still replace it or did they just not bother asking when it was purchased?

Mine is now 14 months old now and has started crashing over the past 2 days, it seems to be heat or GPU related....console freezes with checked squares on the top half of the screen, no red lights and works fine again once rebooted.

So if it ends up totally ----ed am I likely to get it replaced for free?

Now when you say warranty are you on about when you purchased it or is that how long you have had this Xbox for.

If you have had this box for 14 months... you could try MS. If they want to charge I can give you some links which you could present to them. Then is they still say no you can make a claim against them.

Oh and that's defo going to crash on you and give the 3 red lights. That's what happened to me the 2 times my 360 showed the red lights.

I got the 360 on release so the 12 month guarantee/warranty ran out in December.

If I get messed about then I'll either claim on my home insurance for it or just buy a new one and hack the other to bits.

Oh and if/when it does give the red lights....you can still open the disc tray and get a game out right?

Yeah that's definatley on it's way out my friend..colours could be green red or blue and it' as you say GPU related causing motherboard damage by not cooling down enough - happend to me 4 times! and it aint your fault

I heard a rumour that apparently they will repair 05 models free for the foreseable future but i think this was for the US only?

Dont bother MS with this if you bought it from a High Street retailer take it back to them and demand a new one.

You just need to be clued up on your rights as a consumer to pull it off, especially the Sale of Goods Act.

I know a bit on the Sales of Goods Act, my likely course of action is to take it up with Game that the goods did not 'conform to contract'....they're inherently faulty. The law's example of an Inherent Fault:

A fault present at the time of purchase. Examples are:
• an error in design so that a product is manufactured incorrectly
• an error in manufacturing where a faulty component was inserted.
The "fault" may not become apparent immediately but it was there at the time of sale and so the product was not of satisfactory standard.

I think that has it spot-on. I also emailed Game months back (whilst still in warranty) to say it was freezing and if it carried on I will want it exchanged in store....so I can say the fault was there and reported to you but has only now fully manifested itself.....must find that email!

So now I'm gonna keep playing it, when it freezes take pics and host them (proof of the freezes as no red lights and it can freeze after 1 hour or 7 hours), then compile a massive email and letter including links to fault reports and send it all to Game.

Great.

i got mine replaced and i bought mine onr elease and i lied on the phone to them saying i got it for christmas, any ways just say its been doing it for months and now its doing it more frequent now you put it down to game crashes before but now you think its the 360 and thay wount say no as you acknoledged that it was already broken before the time your warrenty ran out.

i diddnt get the red lights mine just froze on every game i booted

When mine broke, the warranty period was officially over, they never questioned me on it. Admittedly this was only like 2 weeks after it was over, but still. Just phone them up and say that you got it in April or something, and if they ask for proof, you just say you don't have it. Worst case scenario is they reject you. Worth a shot.

Sorry to hi-jack thread, but i'm thinking I need a new one.
Mine has started crashing far to regualarly, and I do clear my cache now and then.
Should I just walk into Tesco with the 360 I purchased on release date and demand a new one?
Even though i've only had this 360 for about 6 months?

Anything sold has 6 years in which it has to last for it purpose. When mine breaks ill look into this law more closely. I heard about it recently but didnt look it up

No good trying sales of goods act on a gamesconsole. Not gonna happen. Have you registered your console? if you havent then you're in luck. Just register it saying u got it in say june 06.

Games consoles won't be considered something that should last. I've had to work with many cases of people claiming through the sale of goods act and you are only usually successful if its a large plasma or lcd television or a washing machine where electricals are concerned. You also need proof that it was a manufacturing defect and not something that has happened because of wear and tear etc.

GPUs overheating wouldn't be classed as wear and tear. Maybe if the 360 wasn't know for it's high fault rate then I would be able to say... "sure, I will pay a extra £60".

IMO a fault with the 360 is case you can't lose.

Average life cycle on a games console is more than a year so you can use the Sale of Goods act. If they refuse take them to the small claims court you will win your claim uncontested and get a replacement.

Well the first move has been made...will wait and see what Game's response is!

The Sales of Goods Act covers all goods so certainly can be used for a games console...it can be used for any goods bought that are in breach of the Act. Microsoft have said officially that launch 360's had issues, so they have 'inherent faults' and in breach of the Act, also 14 months lifespan for a £300 console is not satisfactory.

If it goes to the Small Claims Court then I have to prove the goods did not conform to contract, an official MS statement is a pretty good start, then a list of the many, many 360 fault websites listing thousands of cases of hardware failure....won't be too hard.

Then you have to look at it from Game's side, replace a console for a good customer (if they bother checking), go to Small Claims and not turn up (giving me an auto win), or go to court risk losing the case which will thwn set a precedent for every other case like this that goes to the small Claims Court.

If it doesn't work out I'll see what MS can do and if that's nothing then I'll just buy another 360 and never use Game again.

Also you have something else on your side. THEY have to prove it WASN'T faulty when you got it. HAHAHA :D

I don't think they do...only in the first six months of the purchase do they have to prove it wasn't faulty. It'll be down to me to prove it was...which like I said won't be too difficult to gather info of widespread hardware failure.

Ah, 6 months. I know I used that for when I made a small claim a while back that was all.

Well that was easy!

Game emailed to say they'll exchange it, the customer service bod said she'll contact the store manager first and reply to let me know when to go in to the store.

Result...well as long as the new unit is a reliable one!

i think you may get a brand new one, if not you may get a returned one that works, they may want to take your hard drive off ya soo copy your saves

OMG....not as easy as it first seemed!

Basically:

Went to Game, handed over console.
Waited 15 minutes.
Guy re-appeared, said console had been chipped!(WTF!?)
Guy said the console has the MS sticker seal intact but missing a 2nd seal(?).
I feel the rage and launch one, console has never been opened or even had a faceplate on it let alone chipped! Then point out I'm not stupid enough to return an illegally modded console AND why would I do this then still be buying full priced games off you..hand Reward for him to check (he declined).
Much anger from me and red-facedness all around.
Girl comes from outback to help and rings Game Customer Services.
Customer Services confirm that launch consoles probably didn't have this mysterious 2nd seal so only the MS sticker seal counts.
Girl offers refund or exchange.
I say I'll have an exchange.
Girl says have none in stock and it will be on Thursday.
I leave shop then think waaaaiiiiit a minute!
Walk back in shop and say I'll have that refund please!
Get refunded £209.99, girl a bit miffed as that £210 off her bonus points or something!

So I'm off to buy a new Core pack (£199.99) with 12 month guarantee, a (bundled) free game...and a tenner in my pocket!!

In the last 2 months, I've had mine replaced twice... because the old one kept freezing with lots of boxs and stuff on the screen... and the 1 I got back about 2 weeks ago, froze for than the old one.

You should be able to get one again for free... phone them up, and tell them... they'll guide you through it all and should be able to get a sticker sent to you by email and send it back.

Game refunded me in full...so I now get to buy a brand new one, with guarantee and a free game...for a tenner less than my 360 cost originally.
