So it seems like my Elite hates Halo 3.

The one my brother got yesterday didn't work, it kept on saying 'Disc unreadable' so I took it back for him this morning and exchanged it for a new one. Well, I got home and I put in the new one... I play and get near the end of the first level... 'Disc unreadable'... WTF?

Now Microsoft have said its my Elite, so they are sending an email that I have to print out and stick on a box to send my Elite away... looks like no Halo 3 for me for a while (They said it could take a month to get there and back)... :|

(Glad I have a Wii and PS3. I'm disappointed, I really wanted to play Halo 3... :'()

Take your elite back to the retailer, don't bother sending it away you've not had it long.

Definitely don't return to MS, make use of your 12 month warranty with the retailer....at least that way you'll get a brand new replacement console.

Ok. What should I do/say?

Phone Argos. Tell them and ask for a replacement?

Do I need to take the hard drive and everything? What do I take to them?

Go to your store, it's much easier for them to tell you to piss off over the phone than in person. Take your console and explain to them that you request a replacement and when they try to take your console off you request to keep your hardrive and that you don't want the hardrive thats included in the new console.

If they tell you to send it back to M$ tell them that the 12 month warrenty is with the store not the manufacturer, by law they have to offer you a replacement under the sales of goods act (see below) as the console was not to a suitable standard when they sold you it.

Sale and Supply of Goods and Services

Under the Sale of Goods Act 1979 and The Supply of Goods and Services Act 1982 traders must sell goods that are as described and of satisfactory quality, and provide services that are to a proper standard of workmanship.

As soon as I read this post, I had to make sure mine worked. H3 is working fine on my Elite, but the H3 disc is scratched to hell, and I don't want to get half way through the game and I have to stop.

All good at this end though.

So I have to take everything... Wires/Controller/HDD (And request that I keep that HDD)/Console? (Could I just take the console?)

Ill print that off, and take it with me later.

(Hanley, how did yours get scratched?)

Is it Microsoft's policy that all Xbox 360's that are taken to a retailer for a replacement that a new console is not given to that person? They have to give it to the retailer to send it to Microsoft for them to send them a new console?

I don't think it is... is it? Argos have to give me a new console there and then... right?

They should do but Apparently all this is changing according to my phone call to trading standards about my Ipod with currys.

My sister picked it up for me from Gamestation yesterday (got it free when I got my Elite), and when she brought it home, it fell out of its holder - it was the tin case one. So, I look at the disc and it's scratched to hell, but I can't bring it back as I've done my knee in and can't walk. But, it's running fine for me so far, just hope it doesn't crash half way through the game.

Argos aren't strict at all about returns. Take it in with the HDD but tell them Microsoft told you to keep it as your card details are on it. Simple.

If they mess you around..as in not replacing it immediately...then demand a refund, you're well within your rights to.

So then get your money back and buy elsewhere (yes you will lose your HDD data) or it will force them to replace it rather than lose money.
