A homeowner was arrested after a burglar plunged from the balcony of his top-floor flat.

The intruder suffered head injuries and is fighting for his life after falling around 30ft on to a concrete path.

Later police arrested the owner and are investigating whether the intruder was pushed.

The incident happened early on Monday when Patrick Walsh, 56, awoke to find the 43-year-old man rifling through his flat.

They argued and the confrontation moved towards the rear window of the flat.

It is believed the intruder then smashed the window and clambered out on to a narrow ledge and fell to the ground.

Mr Walsh phoned police and at around 6.30am officers found the man on the ground outside the smart Victorian apartment block in Chorlton-cum-Hardy,

He was taken to hospital with serious head injuries.

Officers arrested Mr Walsh on suspicion of causing grievous bodily harm with intent and are trying to establish whether the intruder was forced out of the window.

The arrest is expected to fuel arguments about the rights of householders to defend themselves against burglars.

The issue has been high on the law and order agenda since farmer Tony Martin was jailed for shooting dead a burglar in 1999.

Following the Martin affair the Crown Prosecution Service and the Association of Chief Police Officers said any householder can use reasonable force to protect themselves or others, or to carry out an arrest or to prevent crime.

Yesterday Mr Walsh, who was given bail pending further inquiries, refused to speak about the incident.

But his solicitor Victor Wozny said: "My client is not at liberty to say anything because he is under police bail.

"However we appreciate that the public view might be that this is a man arrested in his own home defending his own property."

A neighbour said: "Police arrived in what seemed to be minutes and were there for the whole day.

"It's shocking to find out what has happened but people shouldn't break into other people's houses."

Another resident said: "I presume we will have to respect the burglar's rights while his victim has the nightmare of court hanging over his head. It all seems so unfair."

A spokesman for Greater Manchester Police said they had been called following reports that an intruder had fallen from a top-floor flat.

A 56-year-old man had woken up to find a man in his flat.

"Following an exchange of words, the alleged burglar was found unconscious on the pavement outside the flat.

"It is believed that he had fallen from the fourth-floor window."

He said the man is 43 and lives locally and inquiries are continuing to establish the circumstances surrounding the incident.

Mr Walsh was later released on bail until November. If charged and convicted he could face a life sentence.

Having been the victim of two breakins I believe you should be able to defend yourself in your own home. These people are scum and get all they deserve.

agreed, i think the burgulars shouldnt have many or any rights if they decide to break in. im sure the resident did this in self-defense.

he was tresspassing on someone elses property so why cant the guy defend himself, thats gay that in all honesty the laws in this country are ----

Come on. Why should the Police arrest him, he was defending his property and his belongings.

If the man dies, then its his own fault for breaking in, and trying to take things.

I agree 100% but tell it to the pc mob that listen to the sob story of something like he was only doing it to feed his drug habit and all the rest of the nonsense they come up with. Utter bollocks! he got what he deserved! If it was me I would have thrown him off not pushed him though :D

If he survives, he will most likely get Community Service or wait... 'serious head injuries'... that rings a bell.

Yeah, thats right... he will most likely NEVER have to work, and get benefits for not working from the government, tax payers money.

yeah man, the handles are colour coded with fluorescent (adolescent) handles so i can see them in the dark,
i usually go out into the bush and throw them at trees to get practicing.

I'm going to break from the pack and say I think you should be free to do whatever is deemed "reasonable". I mean if you give homeowners the ability to "do anything they want to detain a intruder" then your left with a situation where people use there homes as place to be free from the law and do terrible things to criminals.

I'm not saying that this bloke is guilty, but if he throw him out to incapacitate him or in a struggle then no problem, however if the bloke had either gave himself up or was already detained/incapacitated then to throw him out the window he should be arrested and found guilty.

My Father's mate got into trouble for beating an intruder. He was in a Pub and then this lad got chatting to him, anyway bloke had to go and my old mans mate carried on drinking then after a bit went home to find the same bloke he was chatting to robbing his house. He beat the crap out of him and then throw him out a top storey window. That's going back a bit, I remember my old man telling me when that Tony Martin Case was going on.

The Home Office is bringing forward legislation giving burglars statutory rights of entry

For some time senior Home Office civil servants have been concerned at householders "have a go" cases such as Norfolk farmer Tony Martin. Concern has centred on injuries incurred by burglars whilst committing their crimes, under moves to be introduced this May burglars will be given legal powers of entry to domestic & business premises.

A pilot scheme led by Lambeth social services has been in action for just over 2 years, social worker Tristram Rogers co-ordinated the scheme. According to Tristram "Matters came to a head when we had a spate of injuries amongst burglars. Two received broken noses at the hands of enraged householders, one cuts after climbing in through a broken window whilst another broke his ankle climbing a fence carrying a stolen TV. The four received nearly a quarter of a million pounds for the injuries and trauma suffered. We contacted the Home Office, plus a delegation of senior burglars and after a strategy meeting in Tahiti, decided the most appropriate solution was to give burglars legal powers of entry. Under the scheme burglars can apply to local magistrates for entry powers, if the applicant can display a track record of burglary and provide character references as to their dishonesty then entry rights are normally granted"

Burglar Dwain Dixon, 19 was one of the earliest licensed burglars, Dwain gives the scheme the thumbs up "This idea's f***king smashing, before it was always a risk turning a place over, I once got chased by this german shepherd and had to dump the video I was nicking, I tried to sue the householder but he'd fled to the Costa del Victim. Now I can just walk up to a place, flash my id card - then I'm in. If I get any trouble I'm able to call on police backup."

A Home Office spokesman admitted the controversial scheme wouldn't be universally welcome, however he defended the scheme on the grounds of health & safety, claiming it would reduce risk for both burglar & victim. It is believed the scheme won't extend to the homes of politicians, Home Office or social services staff.

I found that on Google luckily it is just a wind up though, imagine if it was true?

my old friends dad had a proper samurai sword in corner of one of his rooms, razor sharp, worth a few grand i think (it ok, he was fekin minted). i doubt he'd use that though :/

my town has lots of gun witch is why peaple know better than to break into houses in my town. the last one though, the owners wern't home and there 2 dogs who are very nice, disarmed and almost killed the person
